INTERNAL RULES AND REGULATIONS
At Finca Sa Bastida Luxury Retreat & Spa, we are delighted to welcome all our guests and passing customers. As you know, there is a protocol that we must follow, not only for safety and health reasons, but also for reasons of coexistence.
In accordance with Article 25 of Decree 14/2020 of 18 May on hotel establishments, BOJA No. 42, as amended by Decree 80/2010 on the simplification of administrative procedures, the establishment has the following Internal Regulations, which are binding on all customers of the establishment.
The establishment reserves the right to seek the assistance of law enforcement officers to remove from the establishment any users who fail to comply with the internal regulations or who attempt to access or remain in the establishment for purposes other than the normal use of the service, as well as in cases where the behaviour of guests poses a risk to their own safety, that of other guests or that of the hotel staff.
In accordance with Decree 10/2003, Articles 5 and 7, which approves the General Regulations for the Admission of Persons to Public Entertainment and Recreational Establishments, persons will be prevented from entering and remaining in the establishment in the following cases:
• When users display violent behaviour, especially when they behave aggressively or cause disturbances, create dangerous situations or disturb other attendees, or do not meet hygiene requirements.
• When they cause noise that disturbs the normal running of the establishment.
• When they take measures or adopt attitudes that are contrary to the health and cleanliness of the establishment.
• When they undermine the normal social coexistence of the establishment.
However, in the cases described above, the person is obliged to pay the expenses incurred up to the moment of the prohibition of access.
Furthermore, below are several points to consider within the establishment:
• It is mandatory to shower before using the swimming pools. The use of the swimming pools is prohibited for those suffering from contagious diseases. Glass is also not permitted in the swimming pool area.
• The use of towels on sun loungers is mandatory.
• Topless sunbathing is not permitted in the hotel's common areas.
• The establishment is not responsible for any type of incident or accident in the car park.
• Accommodation reservations begin at 3:00 p.m. on the first day of the contracted period and end at 12:00 noon on the date indicated as the departure date. For possible changes, please consult the reception desk. Extending your stay beyond the described time will result in the obligation to pay for an additional day. Room reservations and stays will not be accepted for children under 14 years of age who are not accompanied by an adult who is responsible for them at all times. The hotel may require written authorisation from the person responsible for the child.
• SMOKING is not permitted in the hotel's restaurants, bars or facilities, except in areas expressly indicated or outdoors. The hotel reserves the right to charge an additional €150 for extra cleaning if you smoke in your room or may terminate your accommodation contract immediately, cancelling your stay without any right to a refund.
• It is not permitted to bring in, remove and/or consume FOOD OR DRINKS outside the premises of restaurants and bars, or to bring food or drinks from outside the establishment.
• All services requested in the room or outside the room that are not listed on the menus may be subject to an additional charge (ice service, crockery, cutlery, etc.).
• Food, meals and drinks may not be taken out of the hotel restaurant.
• Work clothes, strappy tops or wet clothes are not permitted in the establishment's restaurant or buffet.
• Please do not hang clothes or towels on the balconies or windows of the rooms.
• For security reasons, access to rooms is prohibited to persons who are not staying at the hotel. If guests receive visitors, they must remain in the public areas or register at reception. To safeguard the exclusivity, harmony and distinction that define our hotel, access is restricted to guests whose attire is not in keeping with the purpose of their stay.
• The hotel may request a prior guarantee of payment by credit card or cash (not exceeding €999.99) for the services contracted, in accordance with applicable legislation, in particular the Order of 15 September 1978 on prices and reservations.
• Users are obliged to pay for the services provided, as well as for any consumption, at the time the bill is presented at the establishment itself or under the agreed conditions.
• For valuables, guests have access to a safety deposit box in their room at no extra daily charge. The hotel management is not responsible for any items that have not been deposited in this box.
• Theft and intentional damage will be reported immediately. The hotel is not responsible for the theft or loss of any property that has not been deposited in its custody. The hotel assumes no legal responsibility for luggage deposited in the corresponding room or for bicycles or other vehicles parked on the hotel property.
• The furniture and utensils in the rooms, as well as in the rest of the establishment, form part of the services provided and have been arranged with the intention of making guests' stays as pleasant as possible. We therefore ask that they be used appropriately and respectfully. In any case, they are the property of the establishment, so in the event of loss, theft or unjustified damage, the establishment reserves the right to demand payment for them.
• Animals are not allowed on the hotel premises, with the exception of guide dogs used by visually impaired persons in accordance with Law 5/98 of 23 November.
General booking terms and conditions
- Purpose of the general terms and conditions
These general terms and conditions govern the booking of rooms at the hotel, establishing the rights and obligations of both the customer and the hotel establishment, in acoordance with current Spanish legislation.
These general terms and conditions apply to reservations made through the website https://www.fincasbastida.com (herinafter the "Website") and constitute a contract between you (hereinafter "the Customer") and:

The request and processing of reservations on this website implies full and unconditional acceptance of the legal notice, the tems of use and the privacy policy of the website, together with the terms and conditions of the rate and these general terms and conditions of contract, in their latest version. We therefore advise you to visit our website, as we reserve the right6 to change, modify. add or delete any part of these general terms and conditions at any time.
2. Booking process
- The room reservation will be considered confirmed once the customer receives written confirmation (by email, fax or other means) from the hotel.
- The customer must provide accurate and complette information when making the reservation.
- The hotel may require a credit card as a guarantee, or the payment of a deposit according to the conditions stipulated in each rate.
- Finca Sa Bastida Luxury Retreat & Spa offers two payment rates:
PARTIALLY REFUNDABLE RATE: Reservations made under the partially refundable rate allow for cancellation with partial refund, under the following conditions:
Cancellation must be made at least 7 days prior to the scheduled arrival date.
In case of cancellation within the established period, 75% of the total amount of the reservation will be refunded. The remaining 25% will be retained as a management fee and penalty.
If cancellation occurs outside the specified period (less than 7 days before arrival), no refund will be made.
In case of no-show, 100% of the booking amount will be charged and no refund will be made.
- Changes to reservations are subject to availability and may incur additional charges.
NON-REFUNDABLE RATE: Reservations made under the non-refundable rate are subject to the following conditions:
The total amount of the reservation will be charged at the time of the confirmation.
In the event of cancellation, modification or no-show, no refund will be made under any circumstances.
- This rate does not allow for changes in date or ownership.
- Cancellation requests must be made in writing via email to reservas@fincasabastida.com.
- Refunds, if applicable, will be made bya bank transfer to the customer's personal account.
- Refund times may vary depending on the bank.
- We recommend that you read the specific conditions for each rate carefully before confirming your booking.

3. Cancellation and modification policies
- The customer may cancel or modify the reservation within the terms and conditions indicated when making the reservation, which may or may not incur charges, dependeding on the rate selected.
- In the event of a no-show, the hotel may charge the amount corresponding to one or more nights, depending ont he conditons of the booking.
- Modifications are subject to availability and the rates in force at the time of the change.
- The request and formalisation of the booking necessarily imply that each and every one of these general conditions, considered an integral part of the booking and supplemented by the condtions of the rate and the specific applicable legislations, are expressly accepted by you.
- Any bank charges incurred as a result of the cancellation of the booking shall be borne by the customer.
4. Check-in and check-out
- Check-in time is from 3 p.m., unless otherwise indicated by the hotel.
- Check-out time is before 12 noon.
- The customer must inform the hotel if they expect to arrive outside normal reception hours.
5. Prices and payment methods
- The room price includes only the services specified in the booking.
- The applicable VAT (10%) will be inclueded or specifified in the tinal price.
- The applicable sustainable tourism tax (ECOTAX: €4/person/night + 10% VAT) Will be included or specified in the final price.
- Payment may be made at the hotel, unless partial or total prepayment has been required at the time of booking, evidenced by a bank statement presented in advance or upon the quest's arrival at the hotel.
6. Customer obligations
- The customer undertakes to comply with the hotel's rules ande/or internal regulations and to make appropriate use of the facilities.
- The customer shall be liable for any damage caused to the facilities or to other customers through negligence or misuse.
- Unregistered persons may not be accommodated without the hotels's prior consent.
7. Policy on minors and pets
- Minors over the age of 14 must be accompanied by a responsible adult throughout their stay.
- The admission of pets will depend on the specific policy of the hotel and may incur an additional charge.
8. Force majeure
The hotel shall not be liable for any failure to perform or delay caused by circumstances of force majeure, such as antural disasters, strikes or government decisions.
9. Data protection
The personal data provided by the customer will be processed in accordance with current data protection legislation and will be used exclusively for the management of the booking and the provision of services.
10. Applicable law and jurisdiction
The conditions shall be governed by Spanish law. For any dispute arising from the interpretation or application of these conditions, the partis submit to the Courts and Tribunals of the place where the hotel is located, unless the law provides otherwise.
